6.04(a) of Model Conservation Easement Updated…Again

The Pennsylvania Land Trust Association added six words to §6.04(a) of the Model Grant of Conservation Easement and Declaration of Covenants to clarify the provision’s intent. Users are encouraged to adopt this change immediately. The revised subsection reads as follows (revisions in red):

Notice to Holder. Before Owners begin or allow a Subdivision, Improvement, activity, or use that is subject to Review, Owners must (1) notify Holder of the proposed change including with the notice such information as is reasonably sufficient to comply with Review Requirements and otherwise describe the proposal and its potential impact on the Conservation Objectives and (2) receive Holder’s approval.

Readers may recall that PALTA published an update to this section earlier this year after a public review process. Apologies for the inconvenience of this additional modification. The updated model is posted at ConservationTools.org.
